Does Workers’ Compensation Cover Slip and Fall Accidents?

Workers' Compensation

You know that workers’ compensation covers injuries you suffer while doing your job; but, what if you simply slipped and fell at work? While you were at work, your accident wasn’t necessarily work-related, and it seems hard to blame anyone but yourself for the fact that you fell. So, are your injuries covered? Columbus workman’s comp lawyer James Malek explains:

Yes, Workers’ Compensation Covers Slip and Fall Accidents

In general, workers’ compensation covers slip and fall accidents. In fact, workers’ compensation covers all types of accidents that occur on the job. Whether you slipped and fell in the hallway, in the bathroom, in the warehouse or on a slippery sidewalk outside, you can file a claim if you are eligible for benefits.

Two Important Facts about Slip and Fall Accidents

There are a lot of misconceptions about workers’ compensation in Ohio. There are also a lot of misconceptions about slip and fall accidents. With this in mind, here are two important facts you need to know:

1. You Don’t Necessarily Need to Be Doing Your Job When You Get Injured

First, when it comes to workers’ compensation, you don’t necessarily need to be performing your specific job duties when you get injured in order to qualify for benefits. In Ohio, workers’ compensation covers injuries suffered within the scope and course of employment. So, if you were walking to the copier room, walking across the warehouse, or even taking a bathroom break, you could still qualify for benefits.

2. You Can File a Claim Even if You are Responsible for Your Own Injuries (Although You Might Not Be)

Second, workers’ compensation is a “no fault” system in Ohio. This means that (i) you do not need to prove your employer was at fault in order to file for benefits, and (ii) you can file for benefits even if you are to blame for your own injuries (in most cases). So, if you accidentally slipped and fell at work, there is a good chance that a Columbus workman’s comp lawyer will be able to help you secure benefits.

Also, while it might seem like you have no one to blame but yourself, there are numerous factors that can play a role in slip and fall accidents. For example, if the owner of the building failed to perform adequate maintenance or necessary repairs, then the building owner could be responsible for your accident. If this is the case, you could have an additional claim outside of workers’ comp, and your lawyer may be able to seek additional compensation for your accident-related injuries.
